Policy reason for implied consent?

I was talking to a State's attorney the other day and she was telling me that the reason they have implied consent laws is because the majority of the people who refuse the test are twice the legal limit. Now, I've never heard of anything like this, but I didn't know the policy reason off hand, so can someone clarify?

The "majority" must mean 87%. But I'm sure the real reason is that it makes prosecuting that much more difficult.

She claimed that they could subpoena the blood. Though, that still doesn't make sense to me because she explained that they can't subpoena blood under all circumstances so how would she know what percentage of people are twice the legal limit?

I guess the same way they know that a first time DUI arrestee has driven drunk 87times before without getting caught. If you sling enough horseshit against the side of the barn,eventually some of it will start to stick.

Exactly. They don't know and there's no way that they CAN know. So it's just hogwash.
